These terms govern your use of Bellsight, the application at app.bellsight.com. Bellsight is operated by Dave Bell, doing business as Bellsight ("Bellsight", "we", "us"). By using Bellsight you agree to these terms and confirm that you have read the Privacy Policy.
Bellsight and your engagement
Bellsight is provided to clients of our consulting engagements. Accounts are by invitation only; there is no public sign-up.
If your organisation has a signed agreement with us, that agreement governs fees, confidentiality, the handling of your data and liability, and it takes precedence over these terms wherever the two conflict. These terms cover everything else.
Your account
- We create your account and give you a temporary password, which you replace the first time you sign in.
- Keep your password to yourself and do not share your account. If you think someone else has used it, tell us straight away.
- You are responsible for what is done through your account.
Workspaces and roles
Each workspace covers one website. Its members are owners, editors or viewers, and we add and remove members at an owner's request.
A workspace owner confirms that they are entitled to have Bellsight analyse the site the workspace covers, to connect the Google accounts they connect, and to share what they share. Competitor sites and sites for an exploratory audit may be added only for legitimate analysis.
Acceptable use
You agree not to:
- use Bellsight for anything unlawful, or to harm or overload any website;
- try to reach another workspace's data, or get round Bellsight's security or access controls;
- copy, resell or give others access to Bellsight, or copy its data out by automated means, except through the features it provides;
- reverse engineer Bellsight, except where the law allows it.
Your content and data
You, or your organisation, keep all rights in the content and data you bring to Bellsight. You give us permission to store and process it, and to pass it to the service providers named in the Privacy Policy, only to provide Bellsight to you. The Privacy Policy explains what we collect and how we use it.
Google and other services
Connecting Google Search Console or Google Analytics is optional. You do it through Google's own consent screen, and Google's terms continue to apply to your Google accounts. A workspace owner can disconnect a Google service at any time; the Privacy Policy explains what that does.
To measure visibility in AI search, Bellsight sends tracked prompts to AI search engines and reports their answers as they were returned. We do not control those engines or what they say.
AI-generated output
Bellsight uses AI to analyse data and to write descriptions of issues and opportunities, drafts, report summaries and assistant answers. This output can be wrong or incomplete. Drafts mark any claim that could not be checked against a source. Review everything before you publish it or act on it.
Nothing Bellsight produces is legal, financial or other professional advice.
Accessibility results
Bellsight's accessibility checks are automated, and automated checks find an estimated 50 to 70 percent of accessibility issues. A result that known issues have been reduced is not a legal determination, and Bellsight cannot tell you whether a website satisfies any law. For that, ask a qualified lawyer.
The accessibility of Bellsight itself is covered by our Accessibility Statement.
Not a monitoring service
Bellsight checks whether it can reach a site so that it can crawl it, and may tell you when it could not. It is not an uptime or security monitoring service: it does not promise to notice an outage or to tell you about one. If you need monitoring, use a service built for it.
Share links
Anyone who has a share link can see what it points to until the link expires or is revoked. Treat a share link as you would the report itself. A workspace owner can revoke a link at any time.
Availability and changes to Bellsight
We work to keep Bellsight available, but we do not promise that it will be uninterrupted or free of errors. We may change, add or remove features.
Fees
Any fees for Bellsight are set out in your engagement agreement. These terms do not create any fee.
No warranties
Except as your engagement agreement says otherwise, Bellsight is provided "as is" and "as available". To the extent the law allows, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. Search rankings and visibility in AI answers depend on third parties, and we do not guarantee any result.
Limitation of liability
Except as your engagement agreement says otherwise, and to the extent the law allows:
- we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill;
- our total liability for any claim about Bellsight is limited to the fees you paid us for Bellsight in the 12 months before the claim.
Nothing in these terms limits liability that the law does not allow to be limited.
Suspension and ending access
We may suspend or end access to Bellsight if these terms are broken, when your engagement ends, or to protect Bellsight or its users. You can stop using Bellsight at any time. To have your account or a workspace's data deleted, email privacy@bellsight.com; the Privacy Policy explains how deletion works.
Changes to these terms
When we change these terms, we update the date at the top. If a change is material, we ask you to accept the new version the next time you use Bellsight.
Governing law
These terms are governed by the laws of the State of Maine. Any dispute about them is to be decided in the state or federal courts located in Maine, except as your engagement agreement says otherwise.
